Course objectives:
|
Students will focus on the content of constitutionally guaranteed human rights in the Czech Republic, get acquainted with their normative, doctrinal and judicial forms and relevant supranational context in order to understand the interactive dimension between public authority and an individual in the Czech Republic constitutional model and be able to give appropriate assessment from the constitutional point of view.

|
1. Charter of Fundamentals Rights and Basic Freedoms, its presumptions, legal status, characteristics structure, vertical and horizontal relationships and constitutional significance. 2. Ius naturale basis of human rights in the Czech Republic and its consequences, material focus of constitutionality, its content, significance and related case law. 3. Fundamental principles of the Charter, their content, form and specification in individual classifications of human rights. 4. Content of human rights in the Charter, individual, political, minority, economic, social and cultural rights, right to judicial and other legal protection. 5. Inviolability of the person, its types, concept, constitutional grounds, legal regulation and case law. 6. Voting rights, their elements, their constitutional grounds, legal regulation and case law. 7. Freedom of expression and the right to be informed, their constitutional grounds, legal regulation and case law. 8. Rights of national and ethnic minorities, their constitutional grounds, legal regulation, case law, national and supranational protection. 9. Economic, social and cultural rights, their classification, constitutional concept, legal regulation and case law. 10. Right to judicial and other legal protection, its constitutional concept and legal regulation, specific judicial doctrines of the Czech Constitutional Court and the European Court of Human Rights. 11. Relationship of public authority and citizen in view of human rights, its classification according to status negativus, pozitivus, activus and pasivus, constitutive and constituted power. 12. Constitutional justice and its role in protection of constitutionally guaranteed fundamental rights, constitutional complaint of natural and legal person. 13. Public Defender of Rights, his/her legal status, powers and competence. 14. Supranational normative systems of human rights protection, their institutional protection mechanisms and relationship to the Czech Republic constitutionality.

Knowledge - knowledge resulting from the course: |
seznámit se s koncepcí ústavně garantovaných lidských práv v ČR a souvisejícími specifickými ústavněprávními instituty, podrobně se zaměřit zejména na Listinu základních práv a svobod, základní rysy prováděcí zákonné úpravy, jakož i judikaturu Ústavního soudu ČR, vymezit, klasifikovat, analyzovat a zhodnotit komplex naší ústavnosti i jeho jednotlivých rysů s patřičnou identifikací aspektů interakčních, inferenčních a kontextuálních ve významu vnitrostátním i nadstátním dokládající rozpoznání jejich poslání a smyslu, analyzovat postavení a fungování soustav veřejné moci ve smyslu jejich multipartity, tj. zahrnující moc zákonodárnou, výkonnou, soudní, kontrolní, cenově-stabilizační a územně samosprávnou ve smyslu jejich vnitřní i vzájemné konstrukční, funkční, vertikální a horizontální dělbě moci, zhodnotit naši ústavněprávní koncepci veřejné moci z perspektivy naplnění demokracie, efektivity, přiměřenosti, nadstátní komparatistiky, doktrinálních poznatků i axiologických východisek vyjádřených kupř. uznáním přirozenoprávních východisek základních práv, identifikovat ústavněprávní materii a její různé podoby též v prováděcích zákonných úpravách či naopak v dimenzi nadstátních dokumentů, a to v patřičném rozsahu a souvislostech s ústavním základem. |

orientovat se v komplexu problematiky ústavně garantovaných lidských práv v ČR, jejich normativní, doktrinální i judiciální podobě i relevantních nadstátních souvislostech, rozumět a z ústavněprávní perspektivy relevantně nahlížet interakční dimenzi mezi veřejnou mocí a jednotlivcem v ústavním modelu ČR, a rozlišovat ústavní a podústavní dimenzi lidských práv, orientovat se rovněž v teoretických klasifikacích a obsahové hodnotě ústavního katalogu lidských práv ČR, jakož i v mechanismech jeho ochrany, orientovat se v judikatuře zejména ústavního soudu a Evropského soudu pro lidská práva ve smyslu jejích závěrů i interpretační schematiky, aplikovat její závěry na normativní podobu naší ústavnosti a být schopen zhodnotit její dopady , aplikovat teoretické poznatky na příkladech vyžadujících formulaci vlastních kreativních řešení a rozpoznání nosných obsahových linií jednotlivých teoretických doktrín, jakož i schopnost jejich vzájemně proporčního uplatnění a zhodnocení interpretačních alternativ, analyzovat úpravu jednotlivých institutů de lege lata, rozpoznat její nedostatky a umět po komplexním zhodnocení poznatky doktrinálními i mezistátně-komparativními formulovat vlastní argumentačně podložené návrhy nových řešení, ovládnout rozsáhlý odborný pojmový aparát předmětu a osvojit si jeho odpovídající aplikaci, jakož i schopnost volně přecházet mezi jednotlivými tématy na základě rozpoznání jejich souvislostí s dovedností je analyzovat i syntetizovat. |
