Course objectives:
|
Civil procedure law is one of the branches of public law. Despite of its broader scope it is represented in particular by the court proceedings in civil, employment, family, commercial and other matters. The goal of this subject is to introduce the valid legal regulation of civil procedure law, the theory of this branch and its historical backround to students. In its first part, the general provisions of Code of civil procedure and also the proceedings in the first instance are introduced to students.

Introduction to civil procedure, types of civil procedure and principles of civil procedure, sources of civil procedure
Organization of justice, the judiciary persons, judges
Entities of civil procedure (participants, representation), other persons participating in the proceedings, participation of the public prosecutor
Procedural conditions and their evaluation
Procedural steps, time periods, delivery, summonses, conciliation, interim measures of protection, preliminary rulings
Initiation of proceedings (means of initiation, its effects and the action) and its disposal, counterclaim
Proceedings in the first instance (preparation of hearing, hearing, course of proceedings, suspension of proceedings, connection of matters, counterclaim)
Evidence taking and evaluation of evidence by the court
Accelerated proceedings, decisions, types, forms and requirements for decision
Legal force and enforceability of decision
Costs of the proceedings and deciding thereon
Non ? contentious proceedings (in general)

After passing the first part of this subject the students should be able to know basic principles of civil procedure law and should be able to know how the civil procedure functions in the first instance. Students should be able to distinguish the contentious and non ? contentiuos proceedings and should be able to understand the problems of evidence taking. |
