Course objectives:
|
The objective of the course is to provide general overview in the field of the International Commercial Law, it means relationships, which are originating by the international commercial and economic cooperation between legal entities and subjects, which are carrying business on the territory of the different states. International Commercial Law establishes on the basic theoretical knowledge's gained by the study of the International Private Law.

1. Definition, subject, sources of law, methods of regulation, unification of the International Commercial Law 2. Organisation and management of the international commercial relations, granting of licences and concessions for the export and import of the goods 3. Subjects in the international commercial relations including international organisations with significance for economic cooperation 4. Maintenance and protection of the international investments 5. Payments in the international commercial relations, securing of obligations 6. Contracts for sale of goods in the international commercial relations 7. International transport contracts and documents used in international transport 8. Commercial representation in international commercial connections 9. Investment contracts, licensing contracts and other kinds of contracts with importance for international commercial relations 10. Regulation of international trade in the Law of the European Union 11. International commercial arbitration 12. Resolution of commercial disputes in institutional and ad hoc arbitration 13. Recognition and enforcement of the foreign arbitral awards

After passing of the exam of the study subject the student will be able to:
1. explain basic terms of the International Commercial Law,
2. differentiate legal sources of the International Commercial Law contained in International
Conventions, European and Czech Law,
3. to identify the basic principles for the protection of the foreign investments,
4. to determine the conditions for recognition and enforcement of the foreign arbitral awards. |
