Course objectives:
|
The objective of the course is to provide detailed overview in the field of the International Private Law, which is the branch of the Czech Law and which includes rules of law, which are exclusively intended for regulation of the relationships of the civil-, commercial-, family- and labour law with so-called international element, and rules of law, which are intended for the regulation of the practice of the courts and other bodies in the proceeding based on private law cases, in which is included international element.

Definition, subject, sources of law of the International Private Law, methods of the regulation of the legal relationships following from private law with international element,unification of the International Private Law, history of the international private law, European International Private Law
2. Choice of law rules, their classification, connecting factors
3. Qualification problem, application of the foreign law, renvoi
4. Legal status of the aliens in the legal relationships following from private law
5. Direct norms, definition, sources of law, field of application, relation between direct and choice of law method
6. Application of the overriding mandatory rules
7. Choice of law regulation in the field of the legal acts/actions, legal entities
8. Choice of law regulation in the field contract law
9. Choice of law regulation in the field of the Law of Succession and Family Law
10. Choice of law regulation in the field of rights in rem, Labour Law, Law of Cheque and Law of Exchange

Upon completion of the course the student will be able to understand:
1. Legal English terminology in the field of the International Private Law,
2. Historical context of the formation of the International Private Law,
3. System of the legal regulation of the International Private Law,
4. Significance of discipline of the International Private Law.
Upon completion of the course the student will be able to:
1. Explain basic terms of the International Private Law,
2. Distinguish and use sources of the International Private Law incorporated in international treaties, European and Czech Law,
3. Define and apply the concrete rule of the International Private Law,
4. Determine competence and jurisdiction of courts on the ground of the application of the International Procedural Law rules.
