Course objectives:
|
The course is intended to clarify the issue of ownership and residential spaces and co-operative ownership of residential and commercial spaces. The course is designed as an optional, expanding basic education of civil and commercial law. The course is for students of 2nd to 5th year.

Content
|
1. Introduction. The concept of cooperative and co-ownership housing.
2. The basic definition of cooperative housing. The concept of housing cooperatives, cooperative apartment and the basic features of cooperative housing.
3. Modulation by co-operative housing scheme of classical rent. Rights and obligations as a member housing cooperative tenant of the flat (including equity participation in a housing cooperative). The availability of the right lease. Go right to the lease.
4. Administration of cooperative housing.
5. Co-ownership housing, basic concept, definition and principles.
6. Establishment and termination of co-ownership flats (including a statement of the owner of the building).
7. Subject property rights, the legal relations of the common parts of the house and grounds.
8. The rights and obligations of the owner of the apartment (commercial space).
9. Administration buildings with apartments in the property.
10. Mutual comparison of the advantages and disadvantages of the cooperative and owner-occupied housing.
11. Some of the legal risks of the new housing.
12. Transformation of cooperative housing in owner-occupied housing in the former building and folk housing cooperatives.

Knowledge - knowledge resulting from the course: |
Students will understand the issues of ownership and commercial spaces, and co-operative ownership and residential spaces and acquire basic and secondary aspects of the problem, including issues in transfomations of housing cooperatives and ownership changes one form to another.
Student describes major issues and legislation institutes ownership and residential spaces and cooperative ownership and residential spaces, assess their importance in the current socio-economic and legal system, assess the current role of these relationships, identify and define the strengths and weaknesses of current legislation, apply knowledge to model situations in these relationships, will be able to discuss and find solutions in accordance with the legal principles and assess the solutions in accordance with the laws of the Czech Republic and the EU and draw general conclusions.
