Course objectives:
|
Clarifying the importance of study of Roman law for non-lawyers today. After a brief historical introduction will discuss the legal institutions of the Roman private law with regard to developments in the period of pre-classical and Justinian. Interpretation focuses on the core themes (sources of production and learning, subjects of rights, objects, rights, legal negotiations, the Roman private process), and on the basic institutions of private Roman law (debenture, family, inheritance). The subject is an obligatory part of Unit 1 degree in law. It is taught over two semesters.

|
Objasnění významu studia římského práva pro dnešní právníky. Po stručném historickém úvodu budou probrány jednotlivé právní instituty římského práva soukromého klasického s přihlédnutím k vývoji v období předklasickém a justiniánském. Výklad se zaměřuje jednak na základní témata (prameny produkční a poznávací, subjekty práv, objekty práv, právní jednání, římský právní proces), jednak na základní instituty římského práva soukromého (obligační, dědické, rodinné).
LETNÍ SEMESTR
Program přednášek:
1. Význam studia ŘP pro současnost, základní seznámení s průběhem výuky předmětu, doporučená literatura 2. Gaiovy instituce, jejich znovuobjevení a obsah 3. Základní právní terminologie podle romanistického pohledu: ius ve svých různých významech, právní norma, právní vztah, právní činy, právní jednání 4. Ius civile, ius gentium a ius naturale 5. Status libertatis, status civitatis, status familiae 6. Negotium iuridicum a jeho různé typy 7. Elementy obsažené v negotium iuridicum : essentialia, naturalia, accidentalia 8. Condicio, dies, modus 9. Vůle, její možné projevy a vady: error, dolus, vis 10. Římský privátní proces: legis actiones, formulae, cognitio extra ordinem 11. Věci v ŘP 12. Věcná práva, omezení vlastnických práv
Program seminářů: 1. Založení Říma a jeho právní uspořádání v jednotlivých obdobích, římské kněžské sbory a jejich právní úkoly 2. Produkční prameny ŘP 3. Poznávací prameny ŘP 4. Organizace římské rodiny 5. Zásnuby a manželství v ŘP
