Course objectives:
|
Civil law is one of the main subjects of teaching law in the master's degree program and a key sector of private law. The aim of the course devoted to the general part of the Civil Code and some part of family law is to introduce students to the legal status of these sectors in the legal order and in particular with their general institutes, which are important for numerous other branches of law.

Termination by getting credits, which shall be granted upon passing a written test at the appropriate level, or upon oral examination.

Private law in the legal system. The system of private law. Basic principles of private and civil law.
History of private law. Concept, subject, system and sources of civil law. Interpretation and application of civil law. Civil relationship, its subject and content. Protection of subjective rights.
Individuals and their personality rights.
Legal persons - general aspects.
Legal entities - corporations, foundations.
Representation.
Things and their classification.
Legal facts - general matters. Legal action.
Legal consequences of defects in legal actions.
Other legal facts. Limitation and prescription periods.
Family law - the concept, basic principles, definition of basic matters.
Marriage - concept, rise, putative marriage, nullity of marriage, extinction.
Identifying and denying parenthood.

Graduate will understand the role and place of civil and family law in the legal system and learn their basic principles, as well as their general knowledge of basic institutes. Based on the knowledge gained the graduate will be able to describe the role and function of civil and family law, interpret their initial concepts and apply the legal rules of its general parts. |
