Course objectives:
|
By the Execution code, the new legal profession bailiff was established. The bailiff leads the executor office and exercises execution activities for remuneration throughout the Czech Republic. This course concentrates mainly on the legal relations arising in the performance of the execution activities carried out by the bailiff. Students will become familiar with the teaching position of a bailiff and his executor office, including responsibility of the bailiff and with the Authority Bailiffs. This course also covers significant issues such as the enforcement order and its enforcement, participants in execution proceedings, the protection of third parties in the course of execution activities. In teaching there will be particular emphasis on the implementation of various methods of judicial execution, as well as on ways to end or postpone judicial execution. The teaching will also be analyzed by the EC directives and related foreign and international standards.

Content
|
1. Concept, functions and sources of judicial execution and the status of a bailiff (Special arrangements in our judicial executions, compared with foreign laws, bailiff competence, his responsibility for the exercise of judicial execution, other activities of the bailiff, the Authority Bailiffs in our country and international.)
2. Prerequisites of the judicial execution and enforcement orders. (Process conditions for decrement of the judicial execution, enforcement orders, their formal and material conditions, enforcement).
3. Execution proceedings participants (Definition of the execution proceedings participants, the mandatory spouse in judicial execution, transfer of rights and obligations of the enforcement order, the protection of the rights of third parties.)
4. Execution procedures (Bailiff selection and the nature of its operations, synergy of third parties in judicial execution, execution of court bailiff and mandate of the bailiff, legal suspension and stop of execution, execution costs.)
5. Payroll deduction (Wages and other income, the basic amount of the intangible, net pay, priority claims, determine the amount of precipitation, the change payer's wages, few taxpayers pay).
6. Commandment Claim (Commandment Claim from bank accounts at a financial institution, the commandment of other monetary claims, disability or property rights.)
7. Sale of movable property (Things that don?t subject to judicial execution, securing movable assets, auction, cash and other things.)
8. Sale of property and business (Housing prices, the auction sale of co-ownership share, sales collateral, business manager, auction company, schedule of distributed nature.)
9. Meeting the rights of non-cash transactions (The clearance, removal of the case, the distribution of matter, the distribution of the common things, performance of work and output.)
10. Judicial execution and bankruptcy, overlapping judicial executions and other enforcement (Legal effects of audition for the ongoing judicial execution, multiple overlapping executions of decisions)
11. Final Seminar (Recapitulation of reciting the substance. Ferenda proposals de lege.)
