Course objectives:
|
The course focuses on occupational health issues as one of the most important goals of labor law and on labor law relations that arise in this context. The lectures will focus mainly on the regulation of processes related to occupational health protection and in which the occupational health services provided play a key role. In connection with the subject of labor law it will be the acquisition of theoretical information and practical experience regarding the role of occupational health services in the area of employee health protection. During the lessons students will get acquainted especially with the legal regulations of occupational medical in national and international importance, with the subjects of occupational medical services, with the categorization of work, with the content and types of occupational medical examinations. The assessment care and labor-law consequences of occupational medical examinations and assessments are also very important. Students will also become acquainted with the necessary components of the provision of occupational medical services, namely professional medical counseling and health surveillance. Graduates of the course will acquire theoretical and practical knowledge that will help them in their work in all areas of application of legal education. Learning outcomes of the course unit. The aim of the course is to provide students with the necessary knowledge to assess the legal aspects of the necessary activities of occupational medical services, which cover the individual topics of the subject (and explain).

Content
|
1. Occupational medicine and its practical importance: occupational medicine, definitions and history; occupational medicine in an international context.
2. Legislation: international standards, national legislation.
3. Subjects of occupational medical services: provider of occupational medical services, employer, employee.
4. Categorization of work, risk work: obligation to categorize work, risk factors of working conditions, mandatory documentation, employer's obligations, closer definition of individual categories of work.
5. Occupational medical examinations: content, criteria for deadlines and deadlines, types, reimbursement.
6. Occupational medical examinations in special cases: occupational medical examinations of pupils and students, drivers of motor vehicles, medical fitness of firefighters, medical fitness of runway and rail transport operators, operation of rules, aviation regime, medical non-medical staff, persons in service.
7. Judicial care: conditions for issuing a medical report for work, the content of the medical report and the assessment, the preparation and transfer, the legal effects of the assessment, the validity of the assessment and the consequences of invalidity, remedies against medical assessments.
8. Legal consequences of occupational medical examinations and assessments: employee without a valid medical opinion, notice for failure to undergo medical examination, factually or legally defective medical opinion, general medical loss, medical specialty loss, transfer to part-time work quarantine, recommendations of the provider of occupational medical services, documentation overview.
9. Professional medical counseling: content of professional medical counseling, range of services, minimum and total time, training of employees, requirement to optimize work environment ergonomics, cooperation in designing, building or reconstructing workplaces. dealing with emergencies in the workplace.
10. Medical supervision: basic definition, updating of risk assessment, record of performed inspection, Mutual relation of workplace supervision and OSH at all workplaces and employers' facilities.
11. Occupational diseases, endangerment of occupational diseases: procedure for recognition of occupational diseases and endangerment of occupational diseases, types of medical opinions, labor-law consequences of occupational diseases.
12. Control and sanctions: public health protection authorities, labor inspection, overlapping, administrative offenses of occupational health service providers.
