Course objectives:

Give to students a notice of fundamental knowledge for assessment of law aspect of necessary activities related with activities of advocates and their employees during law services according to the advocacy act.
The aim of the course is to give students fundamental knowledge required for the assessment of legal aspects of necessary activities of lawyers and their trainees within the course of rendering legal services in conformity with the Act on the Legal Profession.

Active participation in seminars. Elaboration of seminary work. Credit by passing a written test with follow-up oral exam.

1. Introduction - legal amendments of legal profession execution in the Czech Republic, The Act on
the Legal Profession
2. The Czech Bar Association as the body of public administration of legal acts and as the
self-governing estates organization
3. Rights and duties of a lawyer
4. Disciplinary responsibility of lawyers and disciplinary proceedings
5. The relation between the Act on the Legal Profession and the Labour Code
6. The execution of legal profession in employment contract to another lawyer or business
company of lawyers
7. The employment of lawyer trainees
8. Other employees of a lawyer
9. The position of employed lawyers and lawyer trainees in the legal or other
proceedings, the amendment of the procedural legal regulations and estates regulations
10. The education of lawyer trainees within the scope of legal practise, the maintenance of
qualification improvement of lawyers and their employees
11. The basic legal regulations of EU amending the execution of legal profession and their
transformations into the legal code of the Czech Republic
12. The basic estates regulations of the Czech Bar Association

basic knowledge of related disciplines, especially the labor law of the Czech Republic is recommended, but not required |

Knowledge - knowledge resulting from the course: |
- acquire the knowledge of the basic legal terms which may be employed in their future career as lawyers or lawyer trainees |
- identify the basic principles of rendering of legal services |
- particularize and adopt the basic and generally obligatory legal regulations concerning legal profession and estates regulations whose knowledge is required by the Czech Bar Association |
- delimit the role and function of the Czech Bar Association and its individual bodies |
- create the timeline of historical development of legal profession and legal body, also ith the egard to other member states of the European Union |
- apply their theoretical knowledge to model situations of cases where the employment contract between a lawyer and a lawyer trainee is established |
- compare various legal amendments concerning given issues in the rest of European states |
- contextualize labour-law relations and processes which are connected with the material security of persons employed or carrying on business in multiple member states |
- comprehend the significance of the Czech Bar Association self-government and the importance of legal profession from the social point of view |
Skills - skills resulting from the course: |
- analyze the essence of the lawyer´s and lawyer trainee´s performance and labour-law relations which are coming of in the field of legal profession |
- orient themselves in the basic applied principles within the frame of legal regulations which concern the execution of legal profession in the Czech Republic and member states of EU |
- correctly assess and interpret the principles and organization of the Czech Bar Association |
- suggest practical methods and procedures which can be applied to the realization of the labour- law relations within the framework of legal profession |
- create basic documentation and submissions needed for making claims of the persons in the position either of an employee or of an employer in terms of labour-law relation and within the framework of legal profession |
