Course objectives:
|
The course is designed as an elective, optional for students who would be more involved in aviation in the future, whether as lawyers or in-house lawyers, employees of professional aviation authorities or institutes (ÚCL, ÚZPLN) or as professional teachers or journalists. Students should be briefly acquainted with the history and division of aviation, they should acquire the basic terminology, they should also be acquainted with the public regulation of civil aviation (including current principles of environmental protection / climate protection, protection against the negative effects of aviation /) , with the issue of aviation security (including criminal consequences). They will also get acquainted with the methodology of billing air accidents. Furthermore, with the range of private law relations arising in the field of air transport, with the Community regulation of aviation as well as with the issue of air accident investigation. The interpretation should be supplemented by an analysis of significant decisions or cases and enlivened by presentations by aviation professionals (pilots, flight crew members, flight technicians, managers, air accident investigators, etc.).

1.History of aviation, division of aviation fields, aviation registers, history of Czechoslovakia. transport aviation; 2. Legal regulation of airspace, legal regulation of aircraft deck, principles of aircraft registration; 3.International. organizations (ICAO, IATA), aeronautical terminology, meaning of abbreviations, airport markings; 4. Public regulation of civil aviation - international. treaties, EU regulation, laws and prov. regulations; 5. Qualifications of pilots and flight personnel, methods of verification and renewal of qualifications; 6. Basic principles of flight safety (safety) incl. case analysis; 7.Protection of civil aviation against illegal acts (security) incl. case analysis; 8.Possibilities of proceeding against problematic passengers (unruly pax) - international agreements, laws, transport regulations, transport conditions incl. case analysis; 9.Investigation of air incidents and accidents incl. case analysis; 10. Private law relations in the field of air transport, global distribution systems, mediation airline tickets, passenger liability relations; 11. Liability of air carriers for flight cancellations or delays, cases of exclusion of carriers' liability; 12. Analysis of significant ECJ / CJEU decisions in relation to the liability of carriers pursuant to Regulation No. 261/2004 of the European Parliament and of the Council; 13. Excursion to the headquarters of Smartwings, a.s. incl. hangar tours.
