Course objectives:
|
The aim of the course is to analyze the factual impact of the European Union law on the national legal system with special focus on the legal practice. It is expected that students do have knowledge on EU Law as well as on the legal system and court praxis of Czech Republic or their Member state.
The course is constructed as multidisciplinary and affects various branches of today's legal practice in the Czech Republic. The system of teaching demonstrates the participants various searching methods for the EU law norms and how they shall be dealt with in the framework of the Czech legal system with possible reference to any other Member state legal system. Legal practice in the member State is subject to its internal norms and proceedings, therefore the course focuses more on the issue of cooperation in justice and home affairs and the main part consists of directives on various aspects of the legal proceedings. The course covers also the topic of the protection of individual rights against the member state and other individuals.
Every lecture is based on one case on specific issue. Students are required to study the case and relevant aspects of law in advance. The lecture is organized as a simulation of the trial, where students are divided into groups reflecting all parties of the dispute and are required to present their reasoning.
Due to the practical aspect of the course it is understood that theoretical literature is meant to be only subsidiary and the main source for students to study shall be the effective legislation both Czech and European as well as the jurisprudence of competent courts.
