Course objectives:
|
The main objective of the course is complexed comprehension of the issue of legal status of ethnical, national, racial, linguistic, language, religious, sexual and other minorities and the evolutionary analysis of the protection of minorities in international, European and domestic law. Analysis of relevant case law. Complexed understanding of the concept and significance of non-discrimination in law and the concept of equality.

The term and concept of minorities and minority rights, definition of basic terms.
Brief historical analysis in the concept of protection of minorities. Current substantive legislation and position of minorities within the UN, the Council of Europe, OSCE, EU.
Current legislation and procedural law in protection of minorities under the international law.
Czech legislation of protection of minorities.
Institutions and instruments of enforcement of the protection of minorities in the EU and the Czech Republic, an assessment of the current state of protection of minorities in the EU - the European Commission Reports.
Topical analysis of particular European primary and secondary legislation regarding the protection of minorities.
