Course objectives:
|
The goal of this module is introduction to students concerning theoretical outcomes how EU law works including its development, principles and position in Czech law. The content includes institutions of EU/EC, their position and relation to Czech institutions, bodies and interconnection between them. After general determination of pillars of EU organization the module covers general principles, elementary features of EU/EC law, mainly arising from the case-law of the ECJ/CFI. Then the position and importance of categories of rights of citizens are covered in relation to public power and supremacy of European law. This implies learning procedural steps, possibilities of actions of various entities within European law in front of competent judicial authorities/ECJ/CFI. Students should learn the legal system of EU law as the one which is common to all the Member states, creating new European legal culture.

Learning outcomes

Knowledge - knowledge resulting from the course: |
The students will be able to: - determine position, role and importance of EU/EC law in the system of legal regulation - identify elementary principles and institutions of EU/EC law, their sense, forms and usage within Czech law and in general - distinguish particular models of institutional and functional framework of public power within EU - evaluate constitutional developments after introduction of European law in Czech republic and analyze its reflections (reforms, sovereignty, competences) - analyze recent features of European constitutional law /Lisbon Treaty/ - identify and evaluate democratic processes in the institutions of EU, identify constitutional aspects of relationship between Czech and European structures - analyze procedural protection of citizens within competent judicial authorities and ECJ/CFI - identify and evaluate content and structure of sources of EU law - apply and evaluate case law of European courts in concrete situations |
