Course objectives:
|
Student should be able to analyse the institutional and functional concept of the state and its basic attributes. Student is capable of defining both forms of government, governance, power-sharing and the structure of the state mechanism, as well as more broadly conceived questions of democracy, the political system and human rights in the constitutional context.

Content
|
1. Theory of state, its methodology and relationship to other branches of science, state as basic phenomenon of society organization, its conceptual features, categories, ways how states are created and cease to exist.
2. Types of states, stages of state development from slave, feudal and national states to supranational integration.
3. Philosophical and social concepts of state, from classical to modern writers, different views of sources of state legitimacy and its appearance.
4. State as a product and, at the same time, creator of law, public authority and law, relationship of legality and legitimacy, positive and natural law, values in law, liability of public authority, the doctrine of law-abiding state (Rechtsstaat).
5. Concept of constitution and its role in current democracies; constitution as product and legal framework for democracy.
6. Internal and external functions of state and state machinery, state organ, civil service and fundamental organizational principles of state.
7. Separation of powers and form of government, their content and significance, separation of powers: constructive and functional, horizontal and vertical, de iure and de facto, relationship of the concept of separation of powers and form of government, forms of government, their types and characteristics.
8. Forms of governance, its content and significance; autocracy and its forms, direct and representative democracy, their mechanisms and mutual relationship, principle of sovereignty of people.
9. Form of state, its content and significance, basic classification and internal structure.
10. Self-government, its content, types, status, significance and relationship to state.
11. Fundamental human rights and freedoms, their content and significance, basic principles and categories of human rights, human rights catalogues, their institutional protection.
12. Electoral systems and their classification, types of electoral systems and their application.
13. Political systems and their classification, status, basic features, significance of political parties.

Knowledge - knowledge resulting from the course: |
získat znalosti nezbytné pro pochopení vzájemných vztahů státu a práva, identifikovat důvody existence veřejné moci a podmínky její justifikace, identifikovat úlohu a postavení lidu ve formování státu a zhodnotit míru legitimity veřejné moci v závislosti na stupni jejího odvození od vůle lidu, klasifikovat, analyzovat a srovnat jednotlivé modely organizace veřejné moci, jakož i různé koncepce a kompetenční rámec státních orgánů v jejich rámci rozeznávaný, klasifikovat a analyzovat funkční pojetí veřejné moci, vysvětlit podstatu jednotlivých činností a zhodnotit jejich význam i vzájemnou provázanost, rozlišit a formulovat základní referenční kritéria hodnocení státu a na jejich základě klasifikačně zhodnotit jednotlivé státy, zejména pak Českou republiku

představit fenomén státu v jeho historických i recentních podobách, analyzovat různá pojetí vztahů veřejné moci a obyvatelstva, rozpoznat jejich různé formy i aspekty a zhodnotit stupeň legitimity různých režimů, analyzovat vztah státu a práva, zhodnotit jeho diferencované podoby a stupeň legitimity , osvojit si a odpovídajícím, způsobem aplikovat odborný pojmový aparát předmětu a jeho pomocí na patřičné úrovni hodnotit aktuální jevy a situace v globálním měřítku, které spadají pod věcný rozsah oboru Státověda |
